Apply for Visa to Spain In Houston

Non-working residence visa

The purpose of this visa is to reside in Spain without carrying out any lucrative activity (work or professional) as long as you have guaranteed and sufficient means of subsistence. This visa does not authorize work.

    The following family members can also obtain the visa:

  • The spouse or common law partner.
  • Children and dependent ascendants who are part of the family unit.

  • National visa application form: Each applicant must fill and sign an application, Applications for minors must be signed by one of the parents.
  • Non-lucrative residence authorization form “EX 01”: Each applicant must complete all sections and sign a copy of . The form for a minor must be signed by one of the minor's parents.
  • Photography. A recent 2x2 inch passport-sized photograph, in color, with a white background, taken from the front, without dark glasses, reflections, or clothing that hides the oval of the face.
  • Valid and current passport. Original and a photocopy of the page or pages with the biometric data of the passport will be presented. The passport must be valid for at least one year and have two blank pages. Passports issued more than ten years ago will not be accepted.
  • Proof of the availability of financial means. Original and a copy of the documents that prove that the applicant has sufficient financial means to cover the expenses of residence in Spain during the year of residence authorization or that prove that he or she has a source of periodic income for himself will be presented and, where appropriate, for accompanying family members.

    The minimum amount required is equivalent to 400% of the IPREM (2400 Euros per month). To this amount must be added 100% of the IPREM (600 Euros per month) for each dependent family member of the applicant.

    • Bank statements from the last twelve months of a checking or savings account will be provided, with a stable balance equivalent to or greater than €28,800 per year, plus €7,200 per year for each dependent family member of the applicant.
    • If he is retired, he must provide proof of a regular source of income (proof of a monthly pension). The minimum amount required is equivalent to 400% of the IPREM per year (28,800 euros). To this amount must be added €100 from the IPREM (7,200 euros) for each family member dependent on the applicant. Bank statements from the last twelve months from a checking or savings account may also be provided.
  • Health insurance. Original and a copy of the public or private health insurance certificate contracted with an insurance entity authorized to operate in Spain. The insurance must cover all risks insured by the public health system in Spain. Travel insurance will not be valid.

    Medical insurance must be taken out that covers the applicant throughout their stay in Spain, without waiting periods for certain benefits, exclusions, co-payments or coverage limits (it must cover 100% of medical, hospital and extra-hospital expenses). If insurance contracted with a US company is presented, the certificate must expressly say that it covers the rest of the world (or, at least, in Spain) and must have at least general coverage of $500,000 with no deductible, reimbursement or co-payments.

  • Certificate of criminal record. Applicants of legal age must present the original and a copy of the criminal record certificate issued by the country or countries of residence in the last five years. The criminal record certificate issued by the US Department of Justice – Federal Bureau of Investigation (FBI) must be presented. State certificates will not be accepted. The certificate must have been issued within six months prior to the visa application. It must be translated into Spanish by a sworn translator and legalized with the Hague Apostille by the Department of State in Washington D.C. A criminal record certificate that has been tampered with or damaged (including damage due to staple removal) will not be accepted under any circumstances. If you have resided outside the United States during the last five years, it is necessary to additionally present the criminal record certificate from those countries in which you have lived, translated into Spanish by a sworn translator and legalized with the Hague Apostille. If you have lived in countries that are not part of the 1961 Hague Convention, the certificate must be legalized by the Ministry of Foreign Affairs of the country and then by the Spanish Embassy or Consulate.
  • Medical certificate. Original and a copy of a medical certificate certifying that the applicant does not suffer from diseases that may have serious implications for public health in accordance with the International Health Regulations 2005.

    It must have been issued within three months.

  • Proof of residence in the consular district. The applicant must be legally residing in the boundaries of this Consulate General (Alabama, Arkansas, Louisiana, Mississippi, New Mexico, Oklahoma, Tennessee and Texas). He must be accredited through a valid US driver's license or state identification card.

    Non-US applicants must present proof of legal residence in the country: a notarized copy of the permanent residence card, long-term visa or work permit (with the visa sticker in the passport). Holders of type B-1/B-2 visas cannot apply for any visa in the US, they must do so in their country of residence.

  • Payment of fees.

    • The residence authorization fee: $12, for each applicant. Form 790 code 052. It must be completed in all its fields and signed in all three copies. initial authorization for temporary residence.
    • Visa fee: for US nationals it is $140. For other nationalities consult the visa fees section.

    Payment of both fees will be carried out through a single MONEY ORDER of $152 for US nationals in the name of Consular outsourcing BLS inc. ($12 for the initial temporary residence authorization and $140 for the visa). A Money Order must be provided for each member of the family unit.

  • Affidavit: the applicant must provide:

    • A letter from his employer stating that he no longer works for that company or an unpaid leave.
    • An affidavit signed before a notary that includes the following information:

      • a brief explanation about his work history, the reasons why he has decided to move his residence to Spain, how long he plans to stay and any other circumstances to support his visa application.
      • The postal address in Spain where you are going to reside, at least, for the first three months.
      • The commitment not to carry out any paid work, neither in the United States nor in Spain, under any circumstances, neither in person nor remotely (online), while residing in Spain.
  • Postal Authorization Form: duly completed and signed by applicants who submit their application by postal mail.

Documents needed for family members

For each family member it will be necessary to present:

  • All the requirements mentioned in sections 1, 2, 3, 4, 6, 7, 8, 9 and 10. For minors, the visa application and the application for residence authorization will be signed by one of their parents .
  • Documents that prove the family relationship with the applicant: birth or marriage certificates, issued by the civil registry; certificate of registration as a de facto couple or any other document that proves the relationship as an unregistered couple. US and non-US documents must be legalized with the Hague Apostille and, when applicable, translated into Spanish by a sworn translator.
  • In the event that a minor travels with a single parent, notary authorization from the second parent will be provided, which will be legalized with the Hague Apostille.
  • In the case of children of legal age, documents will be provided that prove the financial dependency, the marital status of the child and that they continue to be part of the family unit.
  • In the case of ascendants, documents that prove economic dependence and that they are part of the family unit.

When necessary to evaluate the application, BLS may request additional documents or data and may also call the applicant for a personal interview.

Procedure

BLS is competent to accept only visa applications from people residing in the consular district.

All non-working residence visas require obtaining an initial residence permit authorization, which is processed at the same time as the visa application.

The visa application will be submitted in person at BLS, by appointment, or by mail by the interested party or by one of their parents, if they are a minor.

  • Proof: BLS may send the interested party by email an application receipt with a code that will allow them to verify the processing status of the file.
  • Correcting the file: BLS may ask the applicant to present missing documents, additional documents or data that are necessary to resolve the request. You may also call the applicant for a personal interview.
  • Deadline to resolve: The legal deadline to make a decision is three months.

Please provide one recent photograph (not more than 6 months old) of yourself, which should not have been used previously in the passport. The photograph should be in colour and:

  • Taken against a white background so that features are distinguishable and contrast against the background.
  • Clear share quality and with the face in focus.
  • Printed on normal photographic paper (camera print).
  • Full face, non-smiling [without sunglasses, a hat/cap or other head covering, unless the applicant wears such items because of their religious belief or ethnic background]
  • Please stick the Photograph on the Visa Application Form.

Note: Please follow these instructions carefully. If photographs presented do not meet these requirements your application will be considered incomplete. A photo booth meeting these requirements is available at the centre.

Resolution period: Once the application is accepted as complete, the period to make a decision is up to 3 months from the day following the registration of the application in the visa system, but this period may be extended if an interview or additional documents. Denial of visa or stay permit for studies. The denial of a visa or authorization to stay for studies will always be communicated by mail, indicating the reasons on which the decision was based.

Resources: In case of denial of a stay authorization for studies or a visa, the applicant may present an appeal in Spanish (by mail with a tracking number) to this Consular Office within a period of 1 month from the day following the date of receipt of the denial notification. A contentious administrative appeal may also be filed before the Superior Court of Justice of Madrid within a period of 2 months from the day following the date on which the applicant receives notification of the visa denial or the dismissal of the appeal for reconsideration.

Once the visa is collected, the applicant must enter Spanish territory during the validity period of the visa.

The visa must be stamped upon entering the Schengen States and within the first thirty days, the applicant must apply for the Foreigner Identity Card or TIE ("Foreigner Identity Card") at the National Foreigners Office in the police station of the city where you will stay.

If the duration of the activity does not exceed 180 days, the visa will be sufficient to prove the stay.
